Election Cirkular
Circular of 22 September 2010 regarding the calling of elections at Aarhus University in autumn 2010.
The election circular is determined in accordance with the Rules and Regulations for Aarhus University of 20 November 2007. The election circular is similarly determined in accordance with Aarhus University’s election regulations of 1 March 2010.
ARTICLE 1
General rules and regulations for holding elections
1.1
Elections are held for the University Board, academy councils, PhD committees, boards of studies and the Master of Public Health Education Committee at the Faculty of Health Sciences.
Article 4 states which election groups have voting rights to the individual bodies.
1.2
Individuals who fall under one of the election groups mentioned in Article 3 on 1 October 2010, as well as the time the election is held, are included in the election lists and are thereby entitled to vote and are eligible for election. Individuals who are on leave on 1 October 2010 or on the date of the election are not included in the election lists and are thereby neither entitled to vote nor eligible for election.
1.3
Elections to collegial bodies are based on lists according to a system of proportional representation with the option of forming list pacts and electoral pacts.
Elections are held electronically. It is also possible to vote using paper ballots. All ballots are secret.

The Elections Committee’s notices regarding the election circular are legally binding and published at www.au.dk/election.

ARTICLE 3
Election groups
The electorate is divided into five election groups:
3.1
Election group I (full-time academic staff and lecturers) comprises staff members working 18½ hours per week or more in positions covered by the ministry’s memorandum on the position structure for academic staff, and not defined in the memorandum as part-time positions. Clinical professors and clinical associate professors are considered the equivalent of full-time academic staff whose main job is at the university. Clinical lecturers in odontology, including senior clinical instructors in dentistry working a minimum of 15 hours per week, are considered the equivalent of full-time academic staff whose main job is at the university. The election group comprises staff members covered by the position structure for academic staff with research tasks at sector research institutions. The election group comprises staff members covered by the position structure relating to the graduate engineer and export engineer degree programmes, as well as staff members employed in accordance with the rules for assistant and associate professors working with the business administration and language degree programmes taught at the Aarhus School of Business departments.
3.2
Election group II (part-time academic staff and lecturers) comprises other staff members covered by the ministry’s memorandum on the position structure for academic staff, and whose employment involves a minimum of 100 salaried hours during the term in which the election is called, or 200 salaried hours in all during the academic year in question.
3.3
Election group III (technical and administrative staff) comprises all technical and administrative staff members working an agreed minimum of 18½ hours per week.
3.4
Election group IV (students) comprises students enrolled at the university in full-time degree programmes. PhD students who do not fall under election group I because of their employment situation belong to election group IV.
3.5
Election group V (part-time students) comprises students enrolled at the university in part-time degree programmes.
3.6
When appointing a PhD committee, employed PhD students who normally fall under election group I are regarded as belonging to election group IV.

ARTICLE 5
Election periods
3.1
The University Board Election group IV is elected for the period 1 February 2011–31 January 2012
Academy councils Election group IV is elected for the period 1 February 2011–31 January 2012
PhD committees Election group I is elected for the period 1 February 2011–31 January 2014
Election group IV is elected for the period 1 February 2011–31 January 2012
Boards of studies Election groups IV and V are elected for the period 1 February 2011–31 January 2012

ARTICLE 6
Election lists
6.1
The Elections Committee draws up lists of individuals with voting rights, based on their workplace or enrolment on 1 October 2010. Each individual with voting rights is indicated by name, election group and a list of the bodies they can vote for. Students enrolled in a full-time degree programme with elective subjects are given voting rights in their main subject. Students enrolled in a Bachelor’s degree programme at the same time as having provisional enrolment in a Master’s degree programme are given voting rights in their Master’s degree programme. Students who would like voting rights in an elective subject instead of their main subject or in their Bachelor’s degree programme instead of their Master’s degree programme should notify the Elections Secretariat no later than 20 October 2010 at 12.00 noon. No changes to the allocation of voting rights are possible after this date.
6.2
Individuals with voting rights can check their right to vote by logging in to the election system at www.au.dk/election.
The election lists are also available on the university’s website at www.au.dk/election from 8 October 2010 until the election is over.
All individuals with voting rights can make objections to errors in the election lists regarding both their own conditions and those of others. Objections must be submitted on special forms available at www.au.dk/election. Objections must be submitted to the Elections Secretariat no later than 20 October 2010 at 12.00 noon. The sender is responsible for ensuring that the notification is received on time by the Elections Secretariat.
6.3
Individuals who meet the conditions for exercising their voting rights in several areas can notify the Elections Secretariat no later than 20 October 2010 at 12.00 noon regarding where they wish to exercise their voting rights. If no such statement is made, the Elections Secretariat decides where the rights are to be exercised.
6.4
After 20 October 2010 at 12.00 noon, no changes to the election lists can be called for. However, as far as practically possible, the Elections Committee will correct actual errors it may be aware of.
6.5
Nobody not included in the election list for a particular election area at the beginning of an election can demand to vote within the area in question.
ARTICLE 7
Nomination of candidates
7.1
Nomination of candidate lists must be submitted electronically at www.au.dk/election or on special forms available at www.au.dk/election. Candidate lists must be notified electronically or submitted to the Elections Secretariat no later than 3 November 2010 at 16.00. The sender is responsible for ensuring that the list is received on time by the Elections Secretariat.
7.2
Candidate lists are approved by the Elections Committee and published at www.au.dk/election. Apart from this, the Elections Committee assumes no responsibility for duplicating further information on behalf of the nominators.
7.3
Candidate lists are registered in the electronic ballot papers in the sequence in which they are received by the Elections Secretariat. If candidate lists for the same body are received at the same time, the order of the candidate lists in question is determined by a draw. Candidate lists included in the list pacts and/or electoral pacts are recorded on the ballot papers in connection with the first received nomination list included in the pact. However, this only applies for candidate lists included in list pacts and/or electoral pacts notified at the same time as candidate lists, i.e. no later than 3 November 2010 at 16.00. Candidate lists included in list pacts and/or electoral pacts notified after 3 November 2010 at 16.00 are recorded in the ballot papers in the sequence in which they are received by the Elections Secretariat. However, the ballot papers always state which lists are in pacts together.
Candidates on lists with equal ranking are registered in alphabetical order by surname.
7.4
Objections to the published candidate lists must be submitted in writing to the Elections Committee via the Elections Secretariat on special forms available at www.au.dk/election no later than 17 November 2010 at 12.00 noon.
7.5
Provided a request is made, approved candidate lists are designated with one of the terms approved for the lists by the Elections Committee. Lists that are not designated can be given a name by the Elections Committee.
ARTICLE 8
List pacts and electoral pacts
8.1
It is possible to enter into
a) list pacts between individual lists.
b) electoral pacts between individual lists and list pacts.
c) electoral pacts between list pacts.
8.2
List pacts and electoral pacts can be entered into on either the nominations of candidates or special forms available at www.au.dk/election. The declaration must be signed by all the candidates included in the lists.
8.3
Notification of list pacts and electoral pacts must be submitted to the Elections Secretariat no later than 12 November 2010 at 12.00 noon. The sender is responsible for ensuring that the notification is received on time by the Elections Secretariat.
8.4
Notifications of list pacts and electoral pacts are approved by the Elections Committee and published at www.au.dk/election.
8.5
Objections to the published list pacts and electoral pacts must be submitted in writing to the Elections Committee via the Elections Secretariat on special forms available at www.au.dk/election no later than 17 November 2010 at 12.00 noon.
ARTICLE 9
Cancellation of ballot
9.1
If the number of candidates listed in an election area does not exceed the number of candidates to be elected, the ballot is cancelled.
9.2
The Elections Committee publishes the cancellation of ballot on 18 November 2010 at www.au.dk/election.
ARTICLE 10
Elections
10.1
The elections are held electronically during the period 22–25 November 2010.
The electronic polling place is accessed via www.au.dk/election. It is possible to vote from all computers with an Internet connection. Guidelines for electronic voting are available at www.au.dk/election.
The electronic elections are open from 22 November 2010 at 09.00 until 25 November 2010 at 16.00.
10.2
It is possible to vote using a paper ballot at the Information Centre, Fredrik Nielsens Vej 5, 8000 Aarhus C.
Voting by paper ballot is possible on 25 November 2010 from 12.00 noon to 16.00. An election official is in charge of the polling place for the paper ballot vote.
10.3
The polling booth where the paper ballot vote is held must be laid out in such a way that nobody can see where people casting votes actually tick off their vote on the ballot paper.
The ballot box must be sealed and designed in such a way that no ballot paper can be removed without opening the box.
Before the first ballot paper is placed in the ballot box, the election official opens it in the presence of witnesses and shows them that the ballot box is empty, after which the election official immediately closes and seals the box in the presence of those attending.
10.4
Voting by paper ballot at the polling place closes when no individuals with voting rights come forward to vote after the published closing time, even though they are encouraged to do so.
10.5
The election official can decide that, during the elections, nobody can be present in the room where the elections are held, apart from the election official and those people either casting votes or waiting to vote. The number of the latter can be restricted in order to maintain law and order.
During the time spent in the room where the elections are held, voters must not in any way campaign for or against any list or candidate.
Those present are obliged to abide by the decisions of the head of the polling place.
10.6
Individuals with voting rights report to the election official at the polling place for the paper ballot vote in the sequence in which they meet up. Voters must show picture identification, after which the election official contacts the Elections Secretariat to verify that that they have not already voted electronically.
Once they have been given ballot papers, individuals with voting rights must immediately enter the polling booth, where nobody else may be present while voting is taking place. Voting takes place by marking a cross in the field for the candidate or candidate list the voter wants to elect.
Having marked a cross on the paper ballot, voters then fold it so that nobody else can see how they have voted, after which they immediately place the ballot papers in the ballot box in the presence of the election official.
10.7
Election officials at polling places for paper ballot votes are not permitted to find out how a voter has voted. It is similarly forbidden to use or relay data from the election lists, apart from information necessary for holding the election.
10.8
If ballot papers are found to be unsuitable for use or incorrectly filled out after being handed to the voter, but prior to being placed in the ballot box, the voter can return to the election official and exchange the unsuitable ballot papers for new ones.
10.9
Voters whose lack of mobility or similar means they are unable to cast their vote by ballot paper in the way prescribed can request assistance from the election official in casting their vote, and the necessary modification of the prescribed procedure can be made at the discretion of the election official. If the voter in question is blind or visually impaired, assistance can be provided in casting their vote either by a person present who is selected by the voter or the election official.
10.11
When the voting by paper ballot is over, the ballot boxes and any ballot papers returned in exchange for new ones must – under close supervision – be taken to the place where determining the results of the election is to be carried out.
ARTICLE 11
Counting of votes
11.1
Counting the votes takes place publicly as soon as possible after voting has closed. The Elections Committee can limit the number of people present depending on the amount of space available.
Counting the votes is headed by the Chair of the Elections Committee.
11.2
A report is released of the votes cast electronically. Votes cast by ballot paper are registered and a combined report is released.
11.3
A vote is submitted for the candidate or list in whose field the voter has marked a cross on the paper ballot. If any doubt arises as to the validity of a paper ballot or which candidate or list has been voted for, the ballot paper is temporarily set aside.
If any doubts should arise in connection with proportional representation elections as to which candidate in the same candidate list the voter wanted to elect, the vote is regarded as submitted on the list, provided it is certain that the voter wanted to elect one of the candidates in the list.
11.4
The Elections Committee determines whether doubtful ballot papers should be regarded as valid or not. A ballot paper is invalid
a) when there is uncertainty regarding which candidate list the voter wanted to elect.
b) when it must be assumed that the ballot paper was not distributed by the Elections Committee.
c) when the ballot paper has been marked in a distinctive way.
If a ballot paper is rejected, the reason for doing so must be stated.
ARTICLE 12
Announcement of results
12.1
The Elections Committee announces the results of the elections and any draws, if applicable, by publishing them at www.au.dk/election and sending them to the collegial bodies.
ARTICLE 13
Election protocol
13.1
When the elections have been tallied up, the Chair of the Elections Committee adds precise details regarding this to the election protocol, so that statements for each election provide details of how the votes were distributed among the different individuals and candidate lists, how the mandates were allotted to these in numerical order, what distribution number was used as a basis for each candidate list, how many personal votes were cast for the candidates, how the list votes were distributed among the candidates and which members were declared elected.
In addition to the final statement regarding the elections, the election protocol must contain details of the number of nomination lists submitted, the names of those nominated, list pacts and electoral pacts, the number of paper ballots submitted, the number of valid votes, and the number of invalid votes, including the reason for rejecting them.
The paper ballots are stored until the deadline for objections has expired, or complaints regarding the elections have been finally settled, after which they are destroyed.
ARTICLE 14
Complaints regarding elections
14.1
Complaints about an election must be submitted in writing to the rector, who obtains a recommendation from the Elections Committee and subsequently makes a decision regarding the matter.
The results of the elections will be published no later than 29 November 2010. However, the election results will be published as soon as they are available. The deadline for complaints expires on 8 December 2010 at 12.00 noon.
If a decision is made in favour of the complainant, and this ruling affects other individuals with voting rights, they must be informed of the decision and that they can complain about it within four working days (except Saturdays) of receiving the notice.
ARTICLE 15
Election decision
15.1
Provided no complaints have been submitted by the deadline stated in Article 14, or submitted complaints have been settled, the elections are regarded as finally decided.
